新嘉財富證券有限公司(「本公司」)個人資料私隱政策聲明

本個人資料私隱政策聲明載列有關本公司所收集及處理與個人資料有關的本公司私隱政策及慣例。本公司在管理個人資料方面透過遵守《個人資料(私隱)條例》(香港法例第486章)(「私隱條例」)致力保障其所持有的個人資料之私隱度、保密性及安全性。本公司積極確保其所有僱員均恪守該等責任。 本私隱政策聲明中所提及的術語與本公司與資料當事人訂立的客戶協議(「客戶協議」)中的術語具有相同的含義。

1. 本公司持有的個人資料類別

客戶於開戶表格所提供的一切資料均構成本公司所持個人資料的一部分。此等資料包括客戶的個人詳細資料、身份證明資料、聯絡資料、僱傭記錄、財政狀況、投資經驗及風險取向。

2. 個人資料之使用

2.1 使用者

有關客戶的所有個人資料(不論是由客戶所提供,還是由其他人士所提供;及不論這些資料是在客戶收到客戶協議之前,還是之後)可在無須客戶事先同意的情況下被任何下列之公司或人士使用(各為一「使用者」):

i. 本公司和/或其任何聯營公司(「集團」);

ii. 集團的任何董事、高級職員、僱員或代理人;

iii. 執行客戶指示和/或從事集團業務而由集團授權的任何人士(包括但不限於律師、顧問、代名人、託管人);

iv. 集團持有與客戶相關的任何權利和義務的任何實際或建議的承讓人;及

v. 任何政府機構、監管機構或其他團體或機構(不論是法例或是任何集團成員適用的規例所要求)。

2.2 目的

客戶的所有個人資料可被任何使用者用於下列目的:

i. 執行新的或現有顧客的查核及信用調查程序,以及協助其他金融機構從事此類工作;

ii. 持續帳目管理,包括收取欠款,強制執行擔保、抵押或其他權利和利益;

iii. 設計提供予客戶之新產品和服務,或向客戶推廣集團的產品;

iv. 將此等資料轉移到香港以外的任何地方;

v. 為了下列目的而進行客戶個人資料的比較(不論收集此等資料的目的及來源,及不論此等資料是向使用者或任何其他人士所收集的):(A)信用調查;(B)資料核實;和/或(C)編製或核實資料,以便採取使用者或任何其他人士認為合適的行動(包括可能與客戶或任何其他人的權利、義務或權益有關的行動):

vi. 用於與客戶有關的任何其他協議和服務之條款所規定之其他目的;

vii. 有關遵守任何法律、規例、法院判決或其他任何監管機構之判決的任何目的;

viii. 任何有關於執行客戶指示或與集團業務或交易有關連的目的。

3. 查閱和修正的權利

根據私隱條例之規定,客戶有權要求本公司讓客戶查閱和修正客戶的個人資料。一般來說(除某些豁免外)客戶有以下的權利:

1. 詢問本公司是否持有與客戶有關的個人資料;

2. 在合理的時間內,客戶可要求查閱其個人資料;

3. 要求修正客戶的個人資料;及

4. 如客戶要求查閱或修正個人資料被拒絕,客戶有權要求說明被拒絕的理由及反對任何該等拒絕。

如客戶要求查閱和/或修正與客戶有關的個人資料,客戶可提出書面要求,並向本公司的資料保護專員遞交其申請。本公司僅會接納由客戶或其授權人士直接提出的要求。本公司或會就處理任何有關要求收取合理費用。

4. 保障措施

本公司的政策為確保個人資料能獲適當程度的保障,以避免未經許可或意外查閱、處理、刪除、遺失或使用有關資料,並會因應資料的敏感程度及因發出生上述任何事件所造成的損害程度提供保障。 本公司亦採取措施以確保處理該等個人資料的人士具備良好操守、審慎態度及辦事能力。若本公司委聘資料處理員(不論在香港以內或以外)代表本公司處理資料,本公司將採用合約形式或以其他手法防止未經許可或意外查閱、處理、刪除、遺失或使用經轉交的資料。 本公司會採取一切可行措施,以確保有關資料的保存時間不會長於就被或將被使用的目的而言所需要保存的時間。

Personal Data Privacy Policy Statement

This Personal Data Privacy Policy Statement sets out the Company’s privacy policies and practices in relation to the personal data collected and handled by the Company. The Company is committed to protecting the privacy, confidentiality and security of the personal data it holds by complying with the requirements of the Personal Data (Privacy) Ordinance (Cap 486 of the Laws of Hong Kong) (“PDPO”) with respect to the management of personal data. The Company is equally committed to ensuring that all of its employees uphold these obligations.

Terms defined in this Privacy Policy Statement have the same meaning as in the client agreement entered into between the Company and the relevant data subject (“Client Agreement”).

1. Types of Personal Data held by the Company

All information provided by the Client in the Account Opening Form forms part of the personal data held by the Company. This includes data such as the Client’s personal details, identification information, contact details, employment record, financial status, investment experience and risk profile.

2. Use of Personal Data

2.1 Users

All personal data concerning the Client (whether provided by the Client or any other person, and whether provided before or after the date the Client receives the Client Agreement containing this information) may be used by any of the following companies or persons (each, a “User”) without the Client’s prior consent:

i. the Company and/or any of its Associates (the “Group”);

ii. any director, officer, or employee or agent of the Group;

iii. any person (including but not limited to lawyers, advisers, nominee, custodian) authorized by the Group when carrying out the Client’s Instructions and/or the business of the Group;

iv. any actual or proposed assignee of any rights and obligations of the Group in relation to the Client; and

v. any governmental, regulatory or other bodies or institutions, whether as required by law or regulations applicable to any member of the Group.

2.2 Purposes

All personal data concerning the Client may be used by any User for the following purposes:

i. carrying out new or existing client verification and credit checking procedures and assisting other financial institutions to do so;

ii. ongoing Account administration, including the collection of amounts due, enforcement of security, charge or other rights and interests;

iii. designing further products and services or marketing a Group product to the Client;

iv. transfer of such data to any place outside Hong Kong;

v. comparison with the Client’s personal data (irrespective of the purposes and sources for which such data were collected, and whether collected by a User or any other person) for the purpose of: (A) credit checking; (B) data verification; and/or (C) otherwise producing or verifying data which may be used for the purpose of taking such action that a User or any other person may consider appropriate (including action that may relate to the rights, obligations or interest of the Client or any other person);

vi. such other purposes as provided in the terms of any other agreements and services relating to the Client;

vii. any purpose relating to or in connection with compliance with any law, regulation, court order or order of any regulatory body; and

viii. any other purpose relating to the execution of the Client’s Instructions or in connection with the business or dealings of the Group.

3. Rights of Access and Correction

The Client has the right to request the Company to give the Client access to and correct the Client’s personal data as set out in the PDPO. In general, and subject to certain exemptions, the Client is entitled to:

1. enquire whether the Company holds personal data in relation to the Client;

2. request access to the Client’s personal data within a reasonable time;

3. request the correction of the Client’s personal data; and

4. be given reasons if a request for access or correction is refused, and object to any such refusal.

If the Client wishes to request access to and/or correction of personal data concerning the Client, the Client should make a written request and address the Client’s request to the Data Protection Officer at the Company. The Company will only accept requests given directly by the Client or its Authorized Persons. The Company may charge a reasonable fee for processing any such request.

4. Protective measures

It is the policy of the Company to ensure an appropriate level of protection for personal data in order to prevent unauthorized or accidental access, processing, erasure, loss or use of that data, commensurate with the sensitivity of the data and the harm that would be caused by the occurrence of any of the aforesaid events. Measures are taken to ensure integrity, prudence and competence of persons having access to personal data. If the Company engages a data processor (whether within or outside Hong Kong) to process personal data on behalf of the Company, the Company would adopt contractual or other means to prevent unauthorized or accidental access, processing, erasure, loss or use of the data transferred. The Company takes all practicable steps to ensure that personal data is not kept longer than is necessary for the fulfilment of the purposes for which such data is or is to be used.
